Jennifer Berman,
Assistant Director of the Office of Legislative Legal Services (OLLS),
presented the out-of-cycle rule issue regarding Rule 18.2.7 of the rules
of the Solid and Hazardous Waste Commission, Department of Public Health
and Environment (CDPHE), concerning solid waste sites and facilities, and
explained why the OLLS recommends that Rule 18.2.7 should be repealed.

Attorney General Lukas Staks, representing the Colorado Solid and Hazardous
Waste Commission, provided testimony regarding the rule issue and explained
why the Commission is contesting the OLLS's assessment of Rule 18.2.7.

Materials and Waste Diversion Advocate for GreenLatinos Colorado, introduced
himself to the Committee and explained that he serves on the advisory board
for the producer responsibility program for statewide recycling in the
environmental justice seat but is not here today as a representative of
the board.

Randy Moorman, Director
of Policy and Community Campaigns at Eco-Cycle, introduced himself to the
Committee and stated the organization's support for Rule 18.2.7.

Three witnesses attempted
to testify remotely, but due to technical difficulties, they were not able
to testify, so Mr. Loma informed the Committee that witnesses Jessica Roff
and Maria Guillen represent the Global Alliance for Incinerator Alternatives,
and witness Samantha Saverin represents Just Zero, an organization focused
on eliminating single-use waste.

issued by the Solid and Hazardous Waste Commission in the Department of

I move that the rules of the Solid and Hazardous Waste Commission, Department of Public Health and Environment, concerning solid waste sites and facilities, 6 CCR 1007-2 part 1, Rule 18.2.7, specified in the Recommendation on page 5 of the memorandum on such rule dated March 6, 2026, be repealed. |
